Introduction

Welcome to Spintara's gaming ecosystem. These Terms of Service ("Terms") establish the rules and guidelines for using our gaming platform, mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services. These Terms apply to all visitors, users, and others who access or use the Services.

Account Registration

To access Spintara's gaming features and community, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately upon becoming aware of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account if we determine that you have violated these Terms or engaged in fraudulent or inappropriate behavior within our gaming community.

User Content

Spintara's platform allows you to create, post, store, and share gaming-related content, including in-game screenshots, videos, player profiles, chat messages, and other materials (collectively, "User Content").

You retain ownership of your User Content. By creating, posting, or sharing User Content on or through our Services, you grant Spintara a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly display, reproduce, and distribute such User Content on and through the Services.

You represent and warrant that:

• Your User Content is original or you have the right to use it and grant us the rights and license as provided in these Terms
• Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity
• Your User Content does not contain any libelous or otherwise unlawful, obscene, or inappropriate material
• Your User Content does not promote cheating, hacking, or other activities that undermine the integrity of our games

We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

Prohibited Activities

To maintain a positive gaming environment, you agree not to engage in any of the following prohibited activities:

• Violating any applicable law or regulation
• Impersonating or attempting to impersonate Spintara, a Spintara employee, another user, or any other person or entity
• Engaging in any harassing, threatening, intimidating, or predatory conduct within our gaming community
• Using cheats, automation software, bots, hacks, or any other unauthorized third-party software designed to modify the Spintara experience
• Exploiting bugs or glitches in our games or Services
• Interfering with or disrupting the Services or servers or networks connected to the Services
• Attempting to access, tamper with, or use non-public areas of the Services
• Using the Services to transmit any viruses, worms, or other malicious code
• Collecting or harvesting any information from the Services without authorization
• Using the Services for any commercial purpose not expressly permitted by these Terms

We reserve the right to investigate and prosecute violations of any of the above to the fullest extent of the law, which may include permanent account suspension.

Intellectual Property

The Spintara Services, including all games, software, graphics, user interfaces, and content, are owned by Spintara and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services or any content, features, or functionality of the Services. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as permitted by these Terms or with our prior written consent.

Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms, fraudulent activity, or behavior that negatively impacts other users' gaming experience.

If you wish to terminate your account, you may do so through your account settings or by contacting our support team. Upon termination, your right to use the Services will immediately cease, and we may delete or archive your account data in accordance with our data retention policies.

Limitation of Liability

In no event shall Spintara, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Game interruptions, server downtime, or data loss
• Any issues related to virtual items, in-game currency, or digital assets

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Disclaimer

Your use of the Spintara Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Spintara, its subsidiaries, affiliates, and its licensors do not warrant that a) the Services will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements. We do not guarantee that our games will be error-free or that gameplay will be uninterrupted.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services and should discontinue use immediately.
